If you sell Medicare Advantage (MA) or Part D (PDP) plans and maintain a consumer-facing website, website compliance is no longer optional.
Effective January 2026, YourPlanChoice, LLC has released updated Compliance Policies and Procedures outlining how agent and agency websites must be structured, reviewed, and approved when referencing MA or PDP products.
This guidance applies to all licensed agents who operate public-facing websites, whether branded or generic.
The policy provides clear direction on:
When a website is considered marketing vs. communications under CMS rules
When carrier and CMS approval is required before a website can be used
Required disclosures, disclaimers, and SMID usage
Rules around permission-to-contact forms and one-to-one consent
CMS expectations for AI-generated content, chat tools, logos, URLs, and terminology
It also highlights common compliance risks that can lead to audits, corrective action, or more serious consequences if not addressed.
CMS increasingly treats agent websites as regulated marketing materials. A well-intentioned website that isn’t properly reviewed or structured can quickly create compliance exposure for agents and agencies.
This policy gives you a clear framework to evaluate your current site and understand what must be approved, updated, or avoided altogether.
