2027 Medicare Rules - Faster Sales, More Liability

Written by www.psmbrokerage.com Admin | Thu, Jul 23, 2026 @ 03:56 PM

The 2027 Medicare rules give agents more flexibility to move from an initial conversation to a sales appointment.

But faster does not mean less compliant.

In the latest episode of The Insurance Producers Guild, we explain how the new rules may speed up the sales process while increasing the importance of documentation, call retention, and lead-source oversight.

Listen here: EP19: 2027 Medicare Rules—Faster Sales, More Liability

Why This Episode Matters

Beginning October 1, 2026, agents will have more flexibility to:

  • Conduct same-day appointments after collecting a Scope of Appointment
  • Transition from an educational event to a sales conversation
  • Deliver the TPMO disclaimer before discussing plan-specific benefits
  • Move more quickly when a consumer is ready to review coverage

The opportunity is speed.

The responsibility is proving that every step was handled correctly.

What We Cover

In EP19, we discuss:

  • The removal of the 48-hour Scope of Appointment waiting period
  • Same-day Medicare appointments
  • Changes to educational-event rules
  • Updated TPMO disclaimer timing
  • Call-record retention requirements
  • Purchased-lead and vendor responsibility
  • The records agents should maintain

The key message is simple:

The rules may allow you to sell faster, but they do not allow you to document less.

Same-Day Appointments

Agents may collect a Scope of Appointment and conduct the appointment on the same day.

This can help when a consumer is ready to discuss coverage and does not want to schedule a second conversation.

The Scope of Appointment is still required before discussing plan-specific benefits.

Same-day does not mean skip-a-step.

Better Conversations, Better Records

The revised TPMO disclaimer timing may allow agents to introduce themselves, confirm the reason for the call, and build rapport before delivering the required language.

However, agents should still document:

  • When the Scope of Appointment was collected
  • When the disclaimer was delivered
  • What products were discussed
  • Whether the call resulted in an enrollment
  • Where the lead originated

Your CRM and call records should clearly show what happened.

Know Your Lead Source

Agents should not rely on a vendor to maintain all lead-generation records.

Keep copies of:

  • Advertisements
  • Landing pages
  • Consent language
  • Lead forms
  • Emails and text messages
  • Vendor agreements

If a vendor cannot explain how the lead was generated, think carefully before contacting it.
